Driveways and Property Accesses Next to Local-Controlled Roads

If your property adjoins a local council-controlled road, you will need to apply for an approval from Council using the below form:

All property accesses need to meet the Council Standards in place at the time of construction. Property accesses must be built to ensure they can handle stormwater. The maintenance of property accesses is the responsibility of the property owner.

Application Process

  1. Prepare Documentation 
    • Ensure your site plan or satellite aerial view plan of the proposed property access includes measurements and distances from property boundaries, street scape trees, utilities and services, and any other relevant infrastructure within the road reserve. 
  2. Submit Your Application 
    • Applications must be submitted via email to Council@gympie.qld.gov.au 
    • Allow sufficient time for review
    • Please be advised that an application fee will be invoiced to the applicant once application has been received. To view the fees and charges associated with this application, please visit our Fees and Charges page
  3. Assessment 
    • Council will review your proposed property access plans and assess them against Council's standard drawings, Council's planning scheme and any other requirements applicable to the proposal. An officer will liaise with you if amendments are required
    • An authority to construct will not be issued until all documentation meets requirements
  4. Authority to Construct  
    • Once accepted, you will receive written confirmation in the form of an Authority to Construct, outlining conditions of acceptance and further information about obtaining final approval

    No works may commence prior to receiving the Authority to Construct

  5. Final Approval 
    • Once construction is complete, follow the instructions in your Authority to Construct to arrange a final inspection with Council 
    • A Council Officer will assess the works and issue final approval if they meet current standards. 
    • Any major non-conformances will be provided in writing, along with required rectification timeframes, before a follow-up inspection is undertaken.

When Should I Apply for Property Access Approval?

This checklist can be used to determine whether the works you are wishing to undertake require a property access approval, or whether works can be completed applying Council's Minor Works on Road Reserve Procedure.

Select the options that apply to your proposed works to determine whether approval is required and the likelihood of approval.

Primary Driveways - Do I need to submit an application?

Q1 - Do you intend to construct a new property access?

Yes - A property access approval from Council will be required. 

No - Proceed to the next question. 

Q2 - Do you intend to change the width of your property access between the road and your property boundary?

Yes - A property access approval from Council will be required. 

No - Proceed to the next question. 

Q3 - Do you intend to change the crossover type? E.g. adding a grate or bridge

Yes - This can be completed under Minor Works on Road Reserve Procedure. 

No - Proceed to the next question. 

Q4 - Do you intend to change the material used to construct your property access?

Yes - A property access approval from Council will be required. 

No - Proceed to the next question. 

Q5 - Do you intend on making any changes to the existing kerb and channel?

Yes - A property access approval from Council will be required. 

No - Proceed to the next question.

Q6 - Do you intend on carrying out basic maintenance on your property access? E.g. repairing cracks, sealing surface

Yes - This can be completed under Minor Works on Road Reserve Procedure.

No -No action required. 

 
Secondary Driveways - Self-Assessment

Before applying for a second driveway, please use the questions below to self-assess whether or not your application is likely to approved.

Note: this self-assessment does not automatically indicate a second driveway will be approved.

Q1 - Does your property have less than 40 meters road frontage?

Yes - Second access unlikely to be approved. 

No, it has more than 40 meters road frontage - Second access may be approved. 

Q2 - Would your second driveway be closer than 12 meters away from your primary driveway?

Yes - Second access unlikely to be approved. 

No, there is more than 12 meters in between - Second access may be approved. 

Q3 - Would your second driveway be closer than 1 meter away from your property boundary?

Yes - Second access unlikely to be approved. 

No, it would be further than 1 meter from the boundary - Second access may be approved. 

Q4 - Would you have equal to or more than the required sight distance listed on Council's Standard Drawings when exiting the new access?

Yes - Second access may be approved. 

No - Second access unlikely to be approved. 

Q5 - Would there be any services (utilities, pram ramps, parking, stormwater pits, etc) within 1 meter of the new access?

Yes - Second access unlikely to be approved. 

No - Second access may be approved. 

Driveways and property accesses next to state-controlled roads

If your property adjoins a state-controlled road, you will need to apply to the Department of Transport and Main Roads (TMR) to make any changes to, or to construct a new driveway or access, using an application form available on TMR's website. Further information can be found here.

All application processes through TMR are free. Applications for changes to driveways not associated with a development application need to be made using Form F5083, which is available on TMR's website in the 'Driveway' section.

Note, construction cannot commence until TMR sends an 'Approval to Commence' letter. When the application form is completed, it can be returned with supporting documentation to bundaberg.office@tmr.qld.gov.au.

Local and state-controlled roads

To identify if your road is a local or state-controlled road, follow the below steps:

  1. Visit www.qldtraffic.qld.gov.au.
  2. Click 'Road Lookup' from the blue menu bar.
  3. Enter the road name into the search bar. If found, you can then see which government authority owns the road and their contact details. If you cannot find the road using the search bar, you can double click on the road on the map.

At this stage, ‘Road Lookup’ is only available on the QLDTraffic website, not the mobile application.
